Regulations of the Sales Platform

These regulations apply to the sales platform existing on this website.

1. Definitions

    Administrator (also Personal Data Administrator) - entity responsible for the EUC DANIEL KOT website, Porębskiego 49 / 480-180 Gdańśk, NIP: 8392790276, REGON: 771583527
    Authorized Service of Electric Unicycles Gotway and VETERAN = Administrator. Begode and Veteran authorization
    Seller - the entity responsible for the production, shipment from China and delivery of the ordered Goods to the Customer in the EU: BEGODE ELECTRONIC LTD. 1 / f, building A, Xiubian Industrial Zone, North-South Avenue, North Community, Humen Town, Dongguan City, Guangdong, China representing and operating in China for BEGODE ELECTRONIC LTD; Web: www.begode.com; contact email: bgd019@begode.com.
    Portal - eucservice.com service and offer platform,
    Sales Platform - part of the Portal that allows the user to place Orders,
    Cookies - small files that save website settings data (e.g. language), logins, etc., stored with the browser,
    Classic registration - the process of creating a user account on the Portal using a minimum login and password,
    User - a natural person, legal person or an organizational unit that is not a legal person, who has a registered account on the Portal, using the Classic Registration.
    Customer - a natural person, legal person or organizational unit that is not a legal person, the specific provisions of which grant legal capacity, which places an Order within the Sales Platform,
    Order - Customer's declaration of intent, aimed directly at the conclusion of the Sales Agreement, specifying in particular the type and number of Goods,
    Goods - products and services presented on the Sales Platform,
    Sales contract - a contract for the sale of Goods within the meaning of the Civil Code, concluded between the Seller and the Customer, concluded using the Portal,
    7-day Start-up Warranty - the warranty period provided by the Administrator to the Customer within 7 days from the date of receipt of the goods (delivery to the indicated address). The warranty covers manufacturing defects revealed within the first 7 days.
    Service - a service provided by the Administrator to the Customer as part of the 7-day Start-up Warranty, as well as the optional, additionally paid, Annual or Two-Year Warranty for the product purchased on the Sales Platform.
    Consumer Rights Act - the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827),
    Civil Code - the Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended),
    Regulations - these Regulations for the provision of electronic services on the Portal, pursuant to art. 8 of the Act on the provision of electronic services.

2. Privacy policy, personal data protection and cookies

    2.1. The administrator acts with respect for privacy and the rights of the Portal users. The protection of personal data of Internet users plays a special role here,
    2.2. The collection, processing and protection of personal data is carried out by the administrator in accordance with these regulations and the relevant provisions of the GDPR Personal Data Protection Act.
    2.3. Personal data is all information relating to an identified or identifiable natural person, such as names, surnames, addresses, e-mail addresses, telephone numbers, data on purchasing behavior, demographic data, etc.,
    2.4. Only personal data provided voluntarily by website users is collected and processed,
    2.5. Personal data is used only for the purposes for which the user has expressly consented,
    2.6. The user always has the right to inspect his data and correct or delete it,
    2.7. User data is protected by multiple encryption methods, password-locked access to databases and keeping them in certified server rooms. The access passwords to the user's account (not applicable to accounts with Facebook login) are additionally encrypted on one side and cannot be read.
    2.8. Classic account registration (using login and password) in the Portal requires confirmation of the e-mail address,
    2.9. The classically registered user will be informed about the possibility of subscribing to the newsletter along with a link confirming the correctness of the e-mail address provided. When the user clicks on the link, he will be saved to receive information selected by him,
    2.10. An email with a confirmation link will be sent a few days after classic registration,
    2.11. If the message is ignored or not delivered, the administrator does not send any newsletter to the e-mail address provided,
    2.12. The User may disable the newsletter at any time in the Portal's settings or by clicking on the link in each e-mail message,
    2.13. User data is not visible outside the administrative system, where they are used to contact the user in case of technical problems,
    2.14. The administrator may, under the pressure of law enforcement authorities, disclose personal data when it is absolutely required by applicable law, an order or in connection with court proceedings,
    2.15. The Portal Administrator collects personal data of users via:
        a) Forms - the forms contained in the Portal may be completed by the user in order to use the Portal's offer, search for information or express opinions.
        b) Cookies
            The website uses cookies to remember user settings, such as the language of the website.
            Cookies are necessary to log in to the Portal and participate in many of its processes - such as writing posts and comments, navigation and making purchases on the Sales Platform.
            The website uses a script to collect anonymous Google Analytics visit statistics, which may additionally place its own cookies. By using the Portal, the user accepts the cookie policy of the Google Analytics system.
            The portal embeds videos from YouTube.com, which may additionally create its own cookies. By using the Portal, the user accepts the Google cookie policy.
            The website uses PayPal payment processors, which may additionally set their own cookies. By using the Portal, the user accepts PayPal's cookie policy.
        c) IP addresses - the Portal saves the IP addresses of users in order to count unique statistics of displayed pages, which helps in the further development of the Portal.
        d) E-mail correspondence, newsletter - the portal saves information on the frequency of opening newsletters in order to display only the content of interest to the user. Additional data provided by the user in e-mail correspondence may also be saved and processed, but only with his consent and for the intended purpose - for example, to carry out the complaint process.

3. General provisions

    3.1. These Regulations define in particular:
        a) Rules for registering and using an account on the Portal,
        b) The terms and conditions for making electronic reservations of products available on the Sales Platform,
        c) The terms and conditions for submitting Orders by electronic means as part of the Sales Platform,
        d) The rules for concluding Sales Agreements with the use of services provided as part of the Sales Platform.
    3.2. The use of the Portal is possible provided that the ICT system used by the Customer meets the following minimum technical requirements:
        a) Internet Explorer 9 or newer with JavaScript enabled, or
        b) Opera or Google Chrome browser with JavaScript support enabled, or
        c) Chrome or Firefox mobile browser,
        c) The minimum screen resolution is 320x240 pixels.
    3.3. In order to use the online store, the Customer should obtain access to a computer station or terminal device with Internet access,
    3.4. In accordance with applicable law, the Administrator reserves the right to limit the provision of services via the Sales Platform to people who have reached the age of 18. In this case, potential customers will be notified of the above,
    3.5. Information about the Goods provided on the websites of the Sales Platform, in particular their descriptions, technical and performance parameters and prices, constitute an invitation to conclude a contract, within the meaning of art. 71 of the Civil Code.

4. Rules for using the Portal

    4.1. The Administrator may deprive the Customer or User of the right to use the Sales Platform, and may limit his access to some or all of the Portal's resources, with immediate effect, in the event of a breach by the Customer or User of the Regulations, in particular when the Customer or User:
        a) during registration on the Portal, he provided untrue, inaccurate or outdated data, misleading or infringing the rights of third parties
        b) has infringed the personal rights of third parties via the Portal, in particular the personal rights of other customers of the Sales Platform,
        c) engage in other behaviors that will be considered by the Administrator to be inconsistent with applicable law or general principles of using the Internet or harming the Administrator's good name.
    4.2. A person who has been deprived of the right to use the Sales Platform may not re-register without the prior consent of the Administrator,

4.3. In order to ensure the security of the transmission of messages and data in connection with the services provided on the Portal, the Portal takes technical and organizational measures appropriate to the degree of threat to the security of the services provided, in particular measures to prevent the acquisition and modification of personal data sent on the Internet by unauthorized persons,
    4.4. Each User and Customer is obliged in particular to:
        a) not to provide or transmit content prohibited by law, e.g. content that promotes violence, is defamatory or violates personal rights and other rights of third parties,
        b) use the Sales Platform in a way that does not interfere with its functioning, in particular through the use of specific software or devices,
        c) not taking actions such as: sending or posting unsolicited commercial information (spam) on the Portal,
        d) use the Sales Platform and the Portal in a way that is not inconvenient for other customers and the Administrator,
        e) to use any content posted on the Sales Platform only for personal use,
        f) use the Portal in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as the general principles of using the Internet.

5. Procedure for concluding a Sales Agreement

    5.1. In order to conclude a Sales Agreement via the Sales Platform, go to the Portal's website, select goods and accessories, taking further technical steps based on the messages displayed to the Customer and information available on the website,
    5.2. The selection of the ordered Goods by the Customer is made by adding them to the basket and selecting the "Go to order processing" option,
    5.3. When placing the Order - until the "Order" button is pressed - the Customer can modify the entered data and the selection of the Goods. To do this, follow the displayed messages and information available on the website,
    5.4. After the Customer using the Sales Platform provides all the necessary data, a summary of the placed Order will be displayed. The summary of the placed Order will contain information on:
        a) the subject of the contract,
        b) unit and total price of ordered products or services, including delivery costs and additional costs (if any),
        c) selected payment method,
        d) the chosen method of delivery,
        e) delivery time.
    5.5. In order to send an Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory and press the "Order with payment obligation" button,
    5.6. Sending the Order by the Customer is a declaration of will to conclude a Sales Agreement with the Seller, in accordance with the Regulations,
    5.7. After placing the Order, the Customer receives an e-mail entitled "Confirmation of placing an order in the eucservice.com store", containing the final confirmation of all essential elements of the Order,
    5.8. The contract is considered concluded with the moment the Customer receives the e-mail referred to above,
    5.9. The sales contract is concluded in Polish, with the content in accordance with the Regulations.

6. Delivery

    6.1. The delivery of the Goods is limited to the area of ​​the European Union and takes place at the address indicated by the Customer when placing the order.
    6.2. The ordered goods are delivered by courier. Delivery costs will be indicated at the time of placing the Order. The delivery costs are:
        PLN 0 - in the case of ordering electric unicycles,
    6.3. Delivery time:
        Shipment of the Goods is carried out within 3 to 7 business days from the crediting of the funds to the Seller's PayPal account,
        If the Administrator is not able to guarantee the shipping time in accordance with the above, the Customer will receive relevant information before making the purchase,
        The time of delivery by a courier company (DHL, DPD, UPS), from the moment the Goods are handed over by the Seller, is from 30 to 40 business days. Carriers, however, reserve the right to provide longer delivery times in some cases. For detailed conditions of carriage, please refer to the regulations of the following carriers: DHL, DPD, UPS.
    6.4. Consolidation, security, disclosure and confirmation to the Customer of the essential provisions of the Agreement for the sale of Goods takes place by sending the Customer to the e-mail address provided confirmation, Order specification and payment confirmation document,

7. Prices and payment methods

    7.1. The correct currency is the US dollar. The prices of the Goods do not include taxes and duties.
    7.2. The user can choose one of the currencies: Zloty (PLN / PLN), Dollars ($ / USD), Pounds (£ / GBP), Euro (€ / EUR). The correct currency is USD by PayPal conversion rate.
    7.3. The customer has the option to pay the price:
        a) payment in the PayPal system.
        b) payment by Visa or MasterCard payment card. The card will be charged immediately after placing the Order (prepayment),
    7.4. The customer accepts their regulations by using the services of external payment operators. The terms and conditions can be found here: PayPal.

8. A declaration of consent to the sending of invoices in electronic form

    Based on Article. 106n paragraph. 1 of the Act of March 11, 2004 on tax on goods and services (i.e. Journal of Laws of 2017, item 1221 as amended), I accept the issuing and sending of invoices in electronic form by EUC Daniel Kot, and BEGODE ELECTRONIC LTD. in accordance with this law.

9. The right to withdraw from the contract

    9.1. The Customer has the right to withdraw from the concluded Agreement within 14 days, without giving any reason,
    9.2. The deadline to withdraw from the Sales Agreement expires after 14 days from the date on which the Customer came into possession of the Goods or on which a third party, other than the carrier and indicated by the Customer, came into possession of the Goods,
    9.3. In order to exercise the right to withdraw from the Sales Agreement, the Customer must inform the Administrator via e-mail (contact@eucservice.com) about his decision to withdraw from the Sales Agreement, by way of an unequivocal statement,
    9.4. To meet the deadline to withdraw from the Agreement, it is enough for the Customer to send information regarding the exercise of the Customer's right to withdraw from the Agreement before the deadline to withdraw from the Agreement,
    9.5. In the event of exercising the right to withdraw from the Agreement, the Customer shall be reimbursed all payments received from the Customer, including the costs of delivering the Goods (except for additional costs resulting from the method of delivery chosen by the Customer other than the cheapest standard delivery method),
    9.6. The refund in the case of point 9.5 will be made by the Seller immediately, and in any case not later than 14 days from the date on which the Administrator was informed about the Customer's decision to exercise the right to withdraw from the Sales Agreement. The reimbursement is made using the same payment methods that were used by the Customer in the original transaction, unless the Customer agreed to a different solution. The customer does not incur any fees related to the refund,
    9.7. The Seller reserves the right to withhold the reimbursement until receipt of the Goods back from the Customer,
    9.8. The Customer is obliged to send or hand over the Goods back to the Seller's address, i.e. BEGODE ELECTRONIC LTD. 1 / f, building A, Xiubian Industrial Zone, North-South Avenue, North Community, Humen Town, Dongguan City, Guangdong, China. The Customer is obliged to return the Goods immediately, and in any case not later than 14 days from the date on which the Customer informed the Administrator about the withdrawal from the Sales Agreement. The deadline is met if the customer returns the Goods before the deadline of 14 days,
    9.9. The Customer is obliged to send back the Goods in the condition as received, i.e. the shipment must contain all Goods and elements received, no Goods or its elements may be damaged. In the case of returning the Goods that the Customer or a third party used in a different way than was necessary to establish the nature, characteristics and functioning of the item (for example, the Customer or a third party used the Goods in a different way than they would in a stationary store), The customer is responsible for reducing the value of things resulting from this.

10. Warranty

    When placing an order, the customer may choose an additionally paid, voluntary, guarantee for the purchased product. The warranty has two variants: an annual period and a 2-year period. The warranty applies to a unicycle purchased via the Sales Platform and is provided by the Service Center. The warranty covers the engine, motherboard and batteries. Unscrewing the housing, e.g. in order to replace an inner tube, does not void the warranty.

11. Complaints about the Goods

    11.1. Complaints arising from the violation of the Customer's rights guaranteed by law or under these Regulations should be sent to the address contact@eucservice.com.The Administrator undertakes to consider each complaint within 14 days, and if it was not possible, to inform within this period The customer, when the complaint is considered,
    11.2. The administrator is not the producer of the goods. The manufacturer is liable under the warranty for the sold Goods under the conditions and for the period specified in the warranty card. If the warranty document provides for such a possibility, the Customer may submit his claims under the warranty directly to an authorized service center whose address is in the warranty card,
    11.3. The administrator has been authorized by the manufacturer of the Goods to run an authorized service, enabling warranty repairs in Poland. Begode authorization

12. Complaints related to the provision of electronic services

    12.1. The Administrator takes steps to ensure that the Portal (including the Sales Platform) is fully operational, to the extent that results from the current technical knowledge, and undertakes to remove any irregularities reported by customers within a reasonable time,
    12.2. The Customer is obliged to immediately notify the Administrator of any irregularities or interruptions in the functioning of the Portal (including the Sales Platform),
    12.3. Irregularities related to the functioning of the Portal (including the Sales Platform) may be reported by the Customer by e-mail to the address contact@eucservice.com,
    12.4. In the complaint, the Customer should provide his name and surname, e-mail address or correspondence address, type and date of irregularities related to the functioning of the Portal,
    12.5. The Administrator undertakes to consider each complaint within 14 days, and if it was not possible, to inform the Customer during this period when the complaint will be considered.

13. Final provisions

    13.1. Users and Customers can access these Regulations at any time via the link on the Portal's home page, download it and print it out.
    13.2. In matters not covered by these regulations, the relevant provisions of the Civil Code (Journal of Laws 1964, No. 16, item 93, as amended),
    13.3. Any disputes and claims related to the Portal will be settled by a common court competent for the Administrator's seat,
    13.4. Settlement of any disputes arising between the Administrator and the Customer who is a consumer within the meaning of art. 22 [1] of the Civil Code, is submitted to the competent courts in accordance with the relevant provisions of the Code of Civil Procedure,
    13.5. Settlement of any disputes arising between the Administrator and the Customer who is not a consumer within the meaning of art. 22 [1] of the Civil Code of the Civil Code, is subject to the court having jurisdiction over the Administrator's seat.
